Privacy Policy

Last updated: September 3, 2026

Wear the Lune LLC operates this store and website. This policy explains what personal information we collect when you visit, make a purchase or contact us, why we collect it, who we share it with, and what control you have over it.

Where this policy and our Terms of Service conflict, this policy governs on anything relating to personal information.

We don't sell your personal information for money. Section 5 covers the nuance under state law.

2. What we collect

Contact details — name, billing address, shipping address, phone number and email address.

Payment information — card details are entered into our payment processor's secure form and never reach our servers. We receive a payment confirmation, the last four digits, the card type and the transaction details.

Account information — username, encrypted password, preferences and settings.

Transaction information — items viewed, added to your cart or wishlist, purchased, returned, exchanged or canceled, and your order history.

Communications — whatever you include when you contact us, plus your email address.

Device and usage information — IP address, browser type, device characteristics, network connection, pages and products viewed, and how you navigate the site.

From third parties — our e-commerce platform, payment processors, shipping partners and service providers supply the information needed to complete your order.

3. How we use it

Purpose What it covers
Fulfilling your order Payment, shipping, delivery updates, returns and exchanges
Account management Creating and maintaining your account, remembering preferences
Customer support Answering questions, resolving problems
Fraud prevention Authenticating accounts, detecting suspicious activity, securing the site
Site improvement Understanding how the site is used and tailoring it
Marketing Email, text and advertising, where you've opted in or the law permits
Legal compliance Responding to lawful requests, enforcing our terms, defending claims

If you have an account, keeping your login details secure is your responsibility. Don't share your username or password with anyone.

4. Who we share it with

  • Our e-commerce platform — hosting, store operation and platform security
  • Payment processors — payment and fraud screening
  • Shipping and fulfillment partners — delivering your order
  • IT, analytics and cloud service providers
  • Customer support tools
  • Advertising and marketing partners — ad measurement and personalized advertising
  • Professional advisers, regulators and authorities — where the law requires it

Each receives only what its function requires. Our marketing partners use information under their own privacy notices.

Legal disclosure. We disclose where required by law, subpoena, search warrant or a valid request from an authority, and where necessary to enforce our terms or protect our rights and the rights of others.

Business transfers. If the business is sold, merged, restructured or enters insolvency, customer records may transfer as part of that.

Categories disclosed in the past 12 months: identifiers (contact details), customer records (name, address, payment confirmation), commercial information (order and support history), internet activity (browsing data), and approximate geolocation derived from IP address — each to the recipient types above.

We don't use sensitive personal information to infer characteristics about you.

5. "Sale", "sharing" and targeted advertising

We don't sell personal information for money.

However, when advertising and analytics technologies run, information about your browsing reaches advertising partners. Under the California Consumer Privacy Act and other state privacy laws, that counts as targeted advertising and, in some states, as "sharing" or a "sale" — regardless of whether payment changes hands.

To opt out:

  • Use the "Do Not Sell or Share My Personal Information" link in our footer
  • Adjust your cookie or privacy preferences on this site
  • Enable Global Privacy Control in your browser — we honor GPC signals for that browser and device
  • Email us at support@wearthelune.com

You can also opt out industry-wide at optout.aboutads.info or networkadvertising.org.

We don't knowingly sell or share the personal information of anyone under 16.

6. Cookies and tracking

Type What it does Optional?
Essential Cart, checkout, login, security No — the site won't work without these
Functional Remembers your settings and preferences Yes
Analytics Traffic and performance measurement Yes
Advertising Ad targeting, measurement and retargeting Yes

You can manage cookies through your browser settings or our privacy controls. Disabling essential cookies will break checkout. Blocking cookies alone may not stop all data sharing with advertising partners — see section 5 for the routes that do.

Blocking a cookie doesn't delete one already stored; you'd clear that separately.

Do Not Track: browsers send DNT signals inconsistently and there's no agreed standard, so we don't act on them. Global Privacy Control is different — we honor it.

7. Our platform provider

Our store is hosted on a third-party e-commerce platform, which collects and processes information about your use of the site in order to provide and secure it.

Certain enhanced platform features also use data from your interactions with our store alongside data from other merchants. For those specific features the platform provider acts as controller in its own right, and requests relating to that processing are handled by them under their own privacy notice.

Everything else described in this policy is handled by us.

8. Information leaving the United States

We may transfer, store and process personal information outside the United States, including through service providers located in other countries.

Where we do, we rely on recognized transfer mechanisms and require appropriate contractual protections.

9. How long we keep it

Data Retention
Order and transaction records 7 years — tax and accounting
Account information Until you delete your account
Marketing contacts Until you unsubscribe
Customer support correspondence 2 years after the matter closes
Site analytics 26 months
Fraud prevention records 3 years

Where a dispute or legal claim is live, the relevant records stay as long as needed. Otherwise they're deleted or stripped of anything identifying.

10. Your rights

Depending on where you live, you may have some or all of these rights:

Know / access — what we hold about you, and how we've used and shared it
Correction — fix anything inaccurate or incomplete
Deletion — delete your information, except records we're legally required to keep
Portability — receive a copy in a usable format
Opt out of targeted advertising, sale or sharing — see section 5
Limit use of sensitive information — where that right applies
Object to certain processing, including direct marketing
Appeal — if we decline a request, you may appeal by replying to our decision
Non-discrimination — we won't charge you different prices or refuse service for exercising these rights

These rights aren't absolute and apply only in certain circumstances. In some cases we may decline a request as permitted by law.

To make a request: email support@wearthelune.com with "Privacy Request" in the subject line. We'll verify your identity — usually by confirming details of a recent order — and respond within 45 days. If a request is complex enough to need longer, we'll say so.

You may authorize an agent to make a request on your behalf. We'll require proof of that authority and may still need to verify your identity directly.

There's no charge for a privacy request.

11. Marketing communications

We may send promotional emails and text messages where you've opted in.

Unsubscribe at any time using the link in any marketing email, or by replying STOP to a text. If you opt out, we'll still send messages about your account or orders — we need those to complete your purchase.

12. Security

We maintain reasonable administrative, technical and physical safeguards designed to protect personal information, as New York's SHIELD Act requires. These include SSL/TLS encryption across the site, restricted internal access, and a PCI-DSS compliant payment processor so card numbers never reach our systems.

No security measure is perfect, and information sent to us may not be secure in transit. Please don't use insecure channels to send us sensitive or confidential information.

If a breach affecting your private information occurs, we'll notify you as required by New York law and other applicable state law.

13. Children

Our site isn't directed at children under 13, and we don't knowingly collect their personal information.

If you're a parent or guardian and believe a child has provided us with information, contact us and we'll delete it.

14. Third-party websites

Our site may link to websites and platforms operated by others. We don't control them and aren't responsible for their content, security or privacy practices — including the accuracy of information found there.

Information you share on public or semi-public platforms may be visible to others. Review the relevant policies before providing anything.

15. Complaints

Contact us first — most things get resolved directly.

If our response doesn't satisfy you, you may appeal by replying to it. If the appeal is also declined, you may lodge a complaint with the New York Attorney General (ag.ny.gov) or your own state attorney general.

16. Changes to this policy

We may update this policy to reflect changes in our practices, our services or the law. The current version is always on this page with the date at the top, and we'll provide notice as the law requires.
